Project: Elimination of corruption schemes for the appropriation of state and communal lands

The project aims to stop abuses of state and municipal land, in particular through "toilet schemes" and the conclusion of contracts that actually replace leases and allow for the circumvention of land auctions.

The EU-Leap team carries out analytical and legislative work in this project, cooperating with the subject of legislative initiative.

Relevance:

The sphere of management of state and municipal land in Ukraine remains vulnerable to large-scale abuses. Corruption practices based on instruments of permanent use and fictitious investment contracts, which actually replace rent without any competition, are widespread. In addition, “toilet schemes” allow, through the privatization of small real estate objects, to formalize rights to significant land plots, which leads to losses for local budgets, non-transparent disposal of assets and devaluation of the institution of public property. At the same time, the current legislation does not provide effective control mechanisms and does not make such abuses impossible.

Project objectives:

Expose key schemes of illegal appropriation of public land, develop legal and institutional mechanisms to block them, conduct a professional assessment of the scale of abuse, form a public agenda around the issue, and ensure the introduction of fair and transparent rules for land use. Particular attention is paid to limiting fictitious investment agreements, permanent use rights, and schemes based on “small real estate.”

Project goal:

Ensure transparent, efficient, and controlled use of state- and municipally-owned land by improving legislation and introducing fair land use rules.

Expected results:

  • removing public land from shadow circulation

  • increasing revenues to local budgets from competitive leasing

  • eliminating shadow schemes for the development of state-owned and municipally-owned land.

Land use reform: eliminating shadow schemes
